| چکیده | ||
| مفهوم انرژی، توسعه و کاربست بهینة آن یکی از مهمترین مسائل مورد توجه کشورهای جهان اعم از صادرکنندگان و واردکنندگان آن میباشد. مسائل مهم و قابل بحثی همچون استخراج، ترانزیت و نحوه و میزان مصرف انرژی به ویژه انرژیهای کربنی در سالهای اخیر به نحوی فزاینده توسعه یافته است و این موضوع پیامد مهمی برای محیط زیست در ابعاد مختلف حقوقی، اقتصادی و حتی سیاسی به همراه داشته است. به همین سبب، امروزه، تقریباً تمامی کشورهای جهان در قراردادهای انرژی خود ملاحظات گستردهای به موضوع زیست داشتهاند. هدف پژوهش حاضر رویکردهای حفاظت از زیستمحیط در قراردادهای نفتی در برخی از کشورهای تولید کنندة نفت است. سوال اصلی پژوهش عبارت است از : «مهمترین رویکردهای موجود در قراردادهای نفتی با تأکید بر موضوع حفاظت از محیط زیست کدامست؟» یافتههای پژوهش با استفاده از روش توصیفی- تحلیلی و استفاده از منابع کتابخانهای و اسنادی نشان داد: 1. عملیات نفتی از آغاز اکتشاف تا پایان بهرهبرداری آثاری منفی برمحیط زیست دارد؛ 2. قراردادهای نفتی در ابتدا توجهی به مباحث محیط زیستی نداشتهاند، اما در سالهای بعدی شروطی جهت حفاظت از محیط زیست در این قراردادها درج شد که این شروط بیشتر جنبه مالی داشتند تا حفاظت از محیط زیست؛ 3. در ابتدای انعقاد قراردادهای نفتی، به حفاظت از محیط زیست توجه نشد و این موضوع صرفاً از تعهدات پیمانکار تلقی شده است. نتایج پژوهش نشان داد از مهمترین عواملی که سبب حفاظت از محیط زیست خواهد شد، ارزیابی آثار زیستمحیطی است و مواردی همچون بیمههای مسئولیت محیط زیستی، کسب مجوز، استاندارد محصولات و فرایندها، اقدامات بعد از ترک میدان، دستور موقت، بهبود مستمر حفاظت از محیط زیست، مقررات تشویقکننده و ضمانت اجرای ایفای تعهد پیمانکار را شامل میشود. | ||
